Supplemental Privacy Notice for California Residents

If you are a California resident, California law provides you with specific rights regarding your Personal Information. This Privacy Notice for California Residents (the “CA Notice”) supplements the information contained in Dynatrace’s Website Privacy Notice (the “Notice”). In the event of a conflict between this CA Notice and the Notice, this CA Notice shall take precedence for California residents. Any capitalized terms not defined in this CA Notice or the Notice have the meanings set forth in the California Consumer Privacy Act of 2018 (the “CCPA”) as amended by the California Privacy Rights Act (the “CPRA”).

This CA Notice does not apply to workforce-related personal information collected from California-based employees, job applicants, contractors, or similar individuals.

The Collection, Source, Purpose and Sharing of Your Personal Information.

Within the last twelve (12) months, Dynatrace has collected the categories of personal information listed in the table below. The table also lists, for each category: (1) the categories of sources from which the personal information was collected; (2) the business or commercial purpose for collecting the personal information; (3) the personal information categories, if any, disclosed to third parties in the preceding 12 months; (4) the business or commercial purpose for disclosing the personal information; (5) whether the personal information was sold or shared it with third parties; and (6) the expected retention period for each category of personal information.

We will retain personal information no longer than necessary to fulfil the purposes described in this Policy or the Notice. If you make a request to know, access, delete or correct your personal information, we may be required to maintain records of these requests and how we responded to the requests in accordance with applicable law.

Your Rights and Choices

The CCPA and CPRA provide California residents with the specific rights listed below regarding their personal information:

Right to know. You have the right to know, at or before the point of collection, which categories of personal information are collected and the purposes for which the categories of personal information are used, and whether such personal information is sold.

Right to access. You have the right to request that Dynatrace disclose to you the categories of personal information, the specific pieces of personal information we have collected, the purposes of the collection, and the categories of third parties to whom we have disclosed your personal information within the previous twelve (12) months.

Right to delete. You have the right to request that Dynatrace deletes any personal information we collected from you and retained, subject to certain exceptions. Dynatrace may deny your deletion request if, upon reviewing your request, we determine that retaining your information is necessary for us or our service provider(s) to:

  • complete a transaction for which the personal information was collected, provide a good or service requested by you, or complete a contract between us and you;
  • ensure our website integrity, security, and functionality;
  • comply with applicable law or a legal obligation, or exercise rights under the law (including free speech rights); or
  • otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

Right to opt-out. You have the right to opt-out of the “selling” or “sharing” of your personal information. To opt-out, please click "Cookies" in the footer of any page.

Right to correct. You have the right to request that any inaccurate personal information Dynatrace holds about you is corrected, subject to certain exceptions. Dynatrace may deny your correction request if (a) we believe the personal information we maintain about you is accurate; (b) correcting the information would be impossible or involve disproportionate effort; or (c) if the request conflicts with our legal obligations.

Right to limit. You have a right to request the Dynatrace limits its use of any sensitive personal information collected to use which is necessary to perform the services.

Right not to be subject to automated decision-making. You have the right to request information about the logic involved in automated decision-making and a description of the likely outcome of processes, and the right to opt out. Dynatrace does not currently engage in any automated decision-making practices.

Dynatrace currently does not respond to “do not track” signals.

If you would like to access, delete, correct or limit the personal information Dynatrace holds about you, or exercise another privacy right available to California residents, please complete and submit a privacy request form.

Please provide us enough information to verify your identity, such as your full name, e-mail address, company name, and any Dynatrace account numbers and usernames you may have. If we cannot initially verify your identity, we may request additional information to complete the verification process. Any personal information you disclose to us for purposes of verifying your identity will solely be used for that purpose.

Timing and Response Format

The Dynatrace Privacy Team will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact CaliforniaPrivacy@dynatrace.com. We will review your request and substantively respond within forty-five (45) days. We will deliver our written response electronically to the e-mail address you provide in your Privacy Rights Request. Any disclosures we provide will only cover the 12-month period preceding the verifiable request’s receipt. If we need more time (up to an additional 45 days), we will inform you of the reason and extension period in writing. If we are unable to comply with your request due to an exception or limitation, we will explain this in writing. We will not charge a fee to process or respond to a request, provided that you make no more than two (2) requests per year in any given twelve (12) month period. We may determine that your request warrants a fee if we believe your request is excessive, repetitive, or unfounded, we will provide you an explanation of the decision and a cost estimate before completing your request.
