Preview Offering: Davis CoPilot™ Capability Specific Terms

Davis CoPilot is powered by generative AI models and is currently only offered on a preview basis. For more information, please visit our Documentation. Capitalized terms not otherwise defined herein shall have the meanings set forth in the Preview Terms.

1. Scope of Use

Customer is solely responsible for any data that Customer inputs into Davis CoPilot (“Input”). Customer acknowledges and agrees that (i) Customer has no claim of right, title, or interest against Dynatrace or third-party end users arising from or related to any identical or similar output generated by Davis CoPilot, and (ii) Davis CoPilot may generate unreliable or inaccurate code, queries, natural language, or other results or output (“Output”), and is not designed for, or intended to be used for, automated decision making.

2. Data Usage and Monitoring

Dynatrace does not use Input or Output to train or retrain Davis CoPilot or third-party AI models for other customers. Customer acknowledges and agrees that, notwithstanding anything to the contrary in the Subscription Agreement, Dynatrace may send Inputs to the LLM Microsoft Azure OpenAI in the region/s published here and store the Inputs (only prompt logging) in the United States, Microsoft Azure US-east, to provide the services contemplated herein. The Inputs sent to Microsoft Azure OpenAI are not retained by Microsoft Azure; the prompt logs created by Dynatrace are retained for 35 days but may be retained longer if abuse is suspected or flagged, or as required to comply with applicable law.

3. Use Restrictions and Acceptable Use

Without limiting any other use restrictions included or referenced in the Subscription Agreement or the PreviewTerms, Customer shall not include personal, proprietary, or confidential information in the Input; and, in accordance with the applicable Microsoft acceptable use policy, Customer shall not use Davis CoPilot:

• in a way prohibited by law, regulation, governmental order or decree;
• to violate the rights of others;
• to try to gain unauthorized access to or disrupt any service, device, data, account or network, including by intentionally evading or disrupting restrictions in metaprompts;
• to spam or distribute malware;
• to mine cryptocurrency;
• in a way that could harm the Preview Offering or impair anyone else’s use of it;
• in any application or situation where failure of the Preview Offering could lead to the death or serious bodily injury of any person, or to severe physical or environmental damage; or
• to assist or encourage anyone to do any of the above.

4. Sections 1 and 2 of these Capability Specific Terms shall survive the expiration or termination of Davis CoPilot Preview Testing.
